An Accra High Court has fined juror Mr. Atipo GHC 1,200 for his absence in the ongoing Kasoa Teenagers Ritual Murder trial, which has stalled proceedings.
The court stated that Atipo’s absence significantly delayed the case, which involves two teenagers accused of murdering 10-year-old Ishamel Abdalla for ritual purposes.
The accused, an 18-year-old and his 15-year-old accomplice, face charges of conspiracy and murder.
Justice Lydia Osei Marfo, presiding over the court as a Court of Appeal Judge with additional responsibilities as a High Court Judge, noted that the case was ready for summation and judgment.
However, due to Atipo’s absence, the trial was adjourned to Thursday, October 24, 2024.
Atipo must pay the fine before the next court date.
In solidarity, his fellow jurors have agreed to forfeit their sitting and transport allowances due to the disruption caused by his absence.
During today’s proceedings, the foreman of the jury reported that Atipo was out of the jurisdiction but had promised to return for the adjourned date.
Justice Marfo expressed frustration, stating that Atipo had previously indicated he would be present today, implying he had effectively held the court “to ransom.”
The judge remarked, “People take everybody for granted in this country. Mr. Atipo did not provide any excuse for his absence.”
In response, Mr. Samuel Atuah, the defense counsel for the 18-year-old accused, requested that the court waive the juror’s fine, arguing it might hinder Atipo’s ability to attend the next hearing and affect the trial’s progress.
Justice Marfo, however, reaffirmed her commitment to enforcing the law, emphasizing that she had previously warned jurors about absenteeism.
