The Dansoman Circuit Court, presided over by Her Honour Halimah El-Alawa Abdul Baasit, has granted bail to a 44-year-old mechanic, Isaac Amo, who has pleaded not guilty to charges of indecent assault.
The charges, which fall under Section 103(1) of the Criminal Offenses Act, 1960 (Act 29), allege that Amo assaulted a nine-year-old girl between 2009 and 2012.
During court proceedings, the charges were explained to the accused in Twi, and he maintained his plea of not guilty.
Counsel for Amo applied for bail, citing Article 19(2)(c) of the 1992 Constitution, which upholds the presumption of innocence until proven guilty.
The defense presented arguments emphasizing the accused’s stable ties to the community.
Amo, who resides at Awoshie in Accra, is a gainfully employed mechanic, married with two children.
His counsel further noted that two individuals were prepared to serve as sureties for him.
The prosecution did not oppose the bail application.
The court subsequently granted bail to Amo, setting the sum at GH¢30,000 with three sureties.
Among the conditions, two of the sureties must be public servants residing within the court’s jurisdiction, with one required to justify their financial capacity.
The case continues as investigations proceed.
Brief Facts
The prosecution told the court that, the complainant Yvonne Opoku-Anarfi is a nurse and mother of victim Chelsea Opoku-Anarfi aged 23 both of them are domiciled in the United State of American.
Whilst the accused lsaac Amo aged 44 a mechanic also live at Awoshie a suburb of Accra.
The Court heard that, during the year 2009/2012 respectively, the complainant brought victim and her sibilng to Ghana in the care of one Doris and the accused in the complainant’s house at Gbawe CP to enable her further her education in the USA.
The victim was then Nine (9) years. During her stay in Ghana, the accused took advantage of the victim and indecently assault her by touching her inappropriately, rubbing his penis on her body and putting it into her mouth until he ejaculates and spread the sperm on her body.
It continue severally until later in the year 2012, when the complainant came for the victim and sibling back to the USA.
However growing up, the prosecution said , the victim kept remembering the ordeal that she went through in the hands of the accused which resulted into her developing depression and suicidal thoughts.
She therefore confided in the complainant about the ordeal whilst she was in Ghana.
She has to go through psychological counselling for her to be emotionaly stable back at the United States of America.
A complaint was lodged with the Odorkor DOVVSU and the accused was arrested and after investigation he was charged with the offence to appear before this Honourable Court
