An Accra Circuit Court, presided over by Judge Mrs. Christina Cann, has sentenced a 25-year-old painter, Kelvin Boateng, to three years in prison for unlawful entry with the intent to commit a crime.
Boateng was charged with unlawful entry, contrary to Section 52 of the Criminal Offences Act 1960 (Act 29/60), and stealing, contrary to Section 124(1) of the Criminal Offences Act 1960 (Act 29/60). He pleaded guilty to the charges.
According to the prosecution, Boateng unlawfully entered the premises of MC Dennis Appau with the intent to steal. His actions were discovered, leading to his arrest and subsequent prosecution.
After considering the facts of the case and his guilty plea, the court handed down a three-year custodial sentence to serve as a deterrent to others.
BRIEF FACTS
The Prosecutor, Chief Inspector Wisdom Alorwu, told the court that, the complainant in this case is MC Dennis Appau a Graphic Designer who lives at La Kojo Sardine whereas the accused person is a painter and lives at Agbogbloshie.
The court heard that, on the 31st of December, 2024 about 10:30am the complainant and witnesses were working in his office in Kojo Sardine.
The accused person scaled the fence wall into the office premises and entered into one of the office,where he look one HP Laptop computer.
On his way out, a witness in this case saw him and raised alarm. He bolted with it and hid in a nearby uncompleted building.
The complainant and other witness mounted search and in the process found the accused person together with the Laptop. He was therefore arrested and brought to the station together with the HP Laplop computer to Police for investigation.
During investigation accused person admitted the offence. After investigation he was charged with the offence as contained in the charge sheet before this honourable court.
