The Clerk to the Parliament, Mr. Ebenezer Ahumah Djietror has officially written to the Chairperson of the Electoral Commission, Jean Mensa notifying her about the vacancy seat in the Kpandai Constituency in the Northern Region.

The notification, dated 4th December 2025, marks the official commencement of the administrative process required to organize a re-run to fill the vacant seat.

According to the Clerk, the action was taken “In exercise of the power conferred and the duty imposed on the Clerk to Parliament by Article 112(5), as amended, of the 1992 Constitution of the Republic of Ghana” adding that the document formally notifies the EC of the vacancy “occasioned by the Order of the High Court, Tamale, for a re-run of the Kpandai Parliamentary Elections, given on the 24th day of November, 2025”.

This notification is a direct consequence of a court order delivered to the Clerk to Parliament as the 4th Respondent in the Suit Number: NR/TL/HC/E13/22/25.

The Clerk’s notification under Article 112(5) of the 1992 Constitution is a mandatory step that legally empowers the Electoral Commission to begin preparations for the re-run.

Article 112(5) stipulates that when a vacancy occurs in Parliament, the Clerk must notify the EC, and an election must be held within 90 days after the vacancy occurs, unless the vacancy occurs within three months before the dissolution of Parliament.Kpandai.

The New Patriotic Party (NPP) led by its Minority Leader in Parliament, Afenyo-Markins has been fighting to over-turn the decision of the Tamale High Court of annulling the 2024 Parliamentary election and ordering for a re-run.

The Effutu MP on November 26, 2025 launched a scathing attack on Ghana’s judiciary, accusing it of acting in the interest of political actors following the Tamale High Court’s decision to annul the 2024 parliamentary election in the Kpandai Constituency.

“The judiciary must know that their actions and inaction to serve the interests of whoever their paymaster is have the tendency of destroying our peaceful republic. We will not mince words. They can conspire to call us one by one for a so-called contempt of court.

“We are criticizing their shameful conduct. We are not afraid. We are ready to be in Nsawam for their so-called contempt. The world will see their disgraceful conduct,” he said.

Mr Afenyo-Markin further took issue with how the ruling was delivered, calling it unprecedented and legally troubling.

“How can a judge who calls himself a judge, sit in court and misconduct himself in such a manner and expect the country to be quiet? This order, with massive political, legal, and democratic consequences, was pronounced without a full written judgment.

“There were no written reasons, no factual findings, no legal analysis, just a naked directive issued into the public domain. And now the whole constituency is being told there must be a rerun.”

The NPP is already struggling with their numbers in Parliament and fear the NDC could win back the seat reducing their numbers further should there be a re-run.
