The trial of Pius Anundoabil Ayoma, 23, and Godwin Klu, 26, who are accused of attempting to escape from lawful custody, is set to commence on January 27, 2025, at the Accra Circuit Court.
The case will be presided over by His Honour Samuel Bright Acquah.
Deputy Superintendent of Police (DSP) Maxwell Oppong, the lead prosecutor, confirmed that all procedural filings have been completed to facilitate the trial. The prosecution has indicated its intention to call three witnesses to testify against the accused.
Charges Against the Accused
Pius Ayoma, an electrician, and Godwin Klu, a tiler, face multiple charges, including conspiracy to escape from lawful custody, causing unlawful damage, escaping from lawful custody, and abetment. During their initial court appearance, Ayoma pleaded guilty to some charges, including conspiracy to escape and causing unlawful damage. However, the court entered a plea of not guilty on his behalf after reviewing his explanation. Ayoma denied other charges, such as conspiracy to cause unlawful damage. Klu pleaded not guilty to all charges.
Background of the Case
The incident dates back to March 2, 2023, when the accused, then remand prisoners at the Manet Police Station, allegedly plotted an escape. Ayoma was awaiting trial at the High Court for charges of robbery, attempted murder, and rape, while Klu was serving a four-year sentence for stealing.
According to the prosecution, the two men broke the burglar-proof bars of their cell window, damaged the wire mesh, and tore the mosquito net to create an escape route. Klu’s attempt to flee reportedly failed due to his body build, but Ayoma successfully escaped with Klu’s assistance.
Ayoma evaded capture until May 4, 2023, when a joint team from the National Investigation Bureau (NIB) and the Ghana Police Service apprehended him at a hideout between Shukura and Afienya.
Prosecution’s Case
In their caution statements, both accused admitted to their roles in the escape attempt. Police officers from the Manet Police Station, who filed the complaint, detailed the extent of the damage caused to the police cell during the incident. The prosecution aims to establish the culpability of the accused through evidence and witness testimonies.
The upcoming trial is expected to provide insight into the circumstances surrounding the escape attempt and subsequent recapture, as the court seeks to determine the guilt or innocence of the accused individuals.
